  • Question on Maximum stay in USA on L1 B visa

    I have a question about L1B.
I arrived in USA on L1 (Blanket) in Sept 2002. I was under assumption that on L1 B anyone will get max. 5 years to stay in USA from the day he/she arrives in USA. Few days back, I received L1B extension with date is shown as Oct. 2008 (which is 6 years from my arrival in USA.) Since Sept 2002 I am in USA except for three weeks of India vacation. New I-94 card attached to the extension state the same date as Oct 2008. My visa case papers filed by company also talk about requesting date of Oct 2008.

Is there any problem with this extension timeframe? If I go on vacation to India sometime in early 2008, does it pose any problem for stamping, as that time I would have completed more than 5+ years on L1 B visa in USA and question will be asked about my overstay in USA during stamping? I was referring to many sites regarding visa but everywhere they are saying you can stay maximum of 5 years on L1 B. So, is there any problem with my case papers filed by company? I am confused with this conflict and do not know what to do. Company says everything is fine as INS has approved our petition and case papers. If there is a problem, how I can rectify it?

Please clarify whether on L1 B a person can stay upto five years or six years.

Expecting a positive reply at the earliest.
