Hi, my husband is on L1 and i am on L2. Our visa has expired and we are on I94. This december i had to come to india on some personal emergency and have made an appointment for L2 stamping in february. If my husband cannot come to india, i have to go for stamping alone. Will they give me L2 visa without the primary L1 being present as L1 has expired but I94 is valid??? Please clarify if its mandatory for both L1 and L2 to be renewed or is it ok if my husband continues to stay in US on I 94 and they will issue me fresh L2??

---- The L1 needs to be extended (if am reading your post right, or if there is no rule for its extension and only the I-94 determines the status and stay on LI)
---- If I-94 ensures status and stay of L1 then you should eb able to proceed for L2 Visa and there is no need to have L1 affixed on the spouse's Passport
