My wife did not come with me when I got my L1 visa stamped. But now we have a child and she cannot stay by herself in India for very long and needs to join me asap. Now she needs to apply for an L2, but the documentation requirement talks about presenting my valid visa as she is applying separately. Does this mean she will not get the visa as my visa is going to expire? Or can she still apply based on the petition extension and I-94 extension application pending with USCIS? Please advise...
