  • L1B individual visa, Chennai consulate, 221(g) refusal

    Hi,
I work for a very reputed software company in Chennai.
I attended L1B (individual) visa stamping at Chennai consulate on 24 April 2007. The VO asked me what I intended to do in the US. I explained that I would be part of my company's team in XX city/state, working for XX client. I also explained that the project was primarily providing production support for customer's infrastructure.
The VO then made me write this down in a sheet of paper and sign it as an affidavit. After that, he consulted his boss inside and then came back.
Then he told me that 'As you must have realized, there is some problem with your petition and I cannot determine your visa status at this time'. He handed me a blue-handout explaining that under section 221(g) of INA I could not be issued a visa at this time, since my petition requires 'additional administrative processing'. He returned my passport (without any stamping) but kept all other documents, including support letter and original I-797.

Now I have nothing to do but wait till they get back to me. There is no time frame specified for this.

    My queries are:

    1. Can a person quit his/her job while L1B petition undergoes AAP? Since L1B is intra-company transferee the petition would get automatically revoked?

    2. Can a person travel on B1/B2 visa (for business trip not exceeding 12 weeks, with client invite letter) to the US while the L1B individual petition is under AAP? Does this affect the processing time, anyone knows?

    3. Has anybody had their petitions revoked after getting 221(g) under similar circumstances? If so, how does it affect the eligibility to apply for fresh H1/L1 petitions?

    4. Please share the time taken for response from Consulate for cases put on hold under 221(g) with AAP. Any success stories after that?

    All the best,
    Fataan.
