  • L1B, division of the company is sold

    I'm holding the L1B visa/status. "maybe" the company will sell the division where I'm belong to. I don't know what my situation will be if the whole division is sold to another company. Per my understanding, the L1 visa is link with the company.
    a. My current L1B is invalid and I have to return my home country?
    b. My current L1B is invalid but the new company could help to apply a new L1 visa for me? Am I still qualified in this case?
    c. my current L1B is still valid even the company I worked has changed?

    I searched the forum but can't find the similar case. Any suggestions? Very appreciate!!!

    It sucks, but basically you AREN'T ANYMORE an employee of the company that requested the L1 visa for you - so you would either need to move to an H1B visa, or head back home. There are some exceptions, though - check:

    Specially this section:

    "For an L-1 visa, the law requires a qualifying relationship between the US entity and the foreign entity from which the employee will be transferring. This relationship must be within the definitions of a “parent, branch, affiliate or subsidiary” as defined by the USCIS. Obviously, changes in the ownership structure of either one of the entities, through a corporate change may terminate the qualifying relationship and, consequently, invalidate the underlying L visas. However, if the petitioner, after a corporate change, can document that the qualifying relationship survives, then, only an amended petition will be necessary. "
