L1 Visa Questions

Hi,

I am working in US from Dec 2006 on L1B Visa. My visa is valid till Mid year of 2009. My employer is asking me to travel back to India and work in Indian company after 1 year. I may be asked to work again in future if required. Please answer following questions.

1. what will happen to my L1 visa which has multiple entry?

2. Can I ask current employer to apply for H1B in April 2008 ?

3. Can I find another employer who can sponsor me H1B in April 2008 ?

4. Will there be any problem for me in future since I am travelling back before the expiry of L1 ?

5. If I stay in India till the expiry of L1 and later if I need to travel on H1B or new L1, how many years are counted for my work stay in US. Is it 1 year or 3 years (L1 validity period).

Your visa will be fine and you can ask anyone to sponsor ypur H1 no problem.

As long as you travel before the expiry you can use the old stamp, if after that you will have to go for restamping.

Only the time spent in US is counted. if you spent 6 months then it will be 6 months and after spending 365 days abroad the clock resets.
