L2 Application after L1 Rejection

Hi,

I am in US on L1 visa. My wife has applied for L1B-Individual from her company but her petition is currently pending becuase of RFE(Request for extra information). I want to know in case if her Petition gets rejeced, then it

1. Will petitio reject be considered as Visa Rejection?
2. In case of petition rejection, can she go ahead to apply for L2 visa because I got to know form someone that you can not apply for L2 for 6 months, if your L1 gets rejected. Is it true?

Please let me know if you have any info this.

1) this is not a visa rejection

2) there is no such rule, infact she might visit now to get her L2 and later when L1 is approved she can visit again to get L1 stamped. I am suggesting this just in case she does not want to wait much longer after L1 denial to get L2.

Thanks a lot for replying.

But can a person apply for both L1 and L2 at same time? And if she gets L2 right now and later her L1 also gets approved then does she need to go to India for personal interview or can that be done in US itself.
