Hi,

My wife & daugther are curently visiting to India & will be returning to US on 5 Feb, 2008. They have L2 dependent visa stamped on their passports till 1 May 2008 against my previous L1B visa. Recently, my employer filed my L1A petition & I have received I-797 valid through Jan 2009. My question are:

1- Can my family re-enter to US with their already stamped visa or they need new visa stamped in lieu of recent I-797?

2- If yes to question 1, then, can they be issued I-94 valid till Jan-2009 or I-94 will match with current visa expiry date i.e. 1 May 2008?

1. They can enter using current visa stamp.

2. Did your employer apply for I-797 extension for dependents also? Or just you?
If just you, I-94 date will be May 1, 2008. If for everyone, I-94 date will be Jan 2009 as long as they carry their I-797 extension.
