    I am working for company A on L1 visa which is expiring in May 2008. So company A is applying for my L1 extention. Now if I apply for a fresh H1B visa through company B in 2008, can that effect my L1 extention application?

    Would appreciate any inputs on this.

    ---- Each Visa application is an independent entity and has no bearing on one another. It is your interest to apply for a H1. However, if you do not join the company be prepared to bear the expenses incurred by that company and other legal proceedings

      If my new H1B gets approved in this case, then does it changes my status automatically to H1B from L1 or my status will change only when I get a new H1B stamp on my passport and reenter US.
      Please let me know.

        ---- There are two ways of getting into H1 at this stage
        1. When applying for H1, apply for COS from L1 to H1, then you get a I-94 for H-1 and you can continue statying in US (unless you wish to go out of the country for personal or business reasons)

        2. Apply for H1 separately. On approval leave the country get a H1 Visa stamped on the Passport and enter the US on with a I-94 for H1 at the POE. This way you retain both L1 and H1. However, you can either be on H1 or L1 status as dictated by you I-94

        ---- You chose what you want to do. However, you will not be permitted to work both on L1 and H1 asn swithching from one status to the other will cost you
