  • I94 - Query

    Hi,

    I am holding L1 visa and entering US on Apr'6th. My visa expires on Jul'7th and i need to be there for 6 months atleast. In POE, can i say the officer that i will be there for 6 months (even though my visa expires on july 7th)?
    on what basis I94 is given ?My petition is valis till 2010 and passport is valid till 2009.

    If i do I94 extension, is it a problem for getting any other US visa next time?

    Please answer my queries.

    Visa expiration sooner than your intended stay is fine. You can enter today if your visa is going to expire tomorrow. No problem. Visa is just for entry to the U.S. and your legal period of stay is determined by I-94 that you will get at the POE.

    You should get an I-94 with the same expiration date as the L1 Approval. I have seen some people getting I-94s upto the date of passport expiration. Make sure you get an I-94 that is valid till the L1 approval date. Yes you can stay with the expired L1 visa as a visa is just for entry to U.S.

        Sure. I would. Just tell the CBP officer that you plan to renew your passport if you suspect that the I-94 will have lesser validity. Make sure the I-94 date is consitent with the L1 approval dates. You can legally work till your L1 is valid and hence should get an I-94 accordingly.

          POE officer will give you the I-94 till DOE of the petition or the passport depending on how observant they are. Once you are in US, the I-94 expiry governs your stay and not the visa.

          Make sure you carry the latest I797 expiring in 2010 and the POE officer will most likely give you that date as the I-94 expiry date.

              Hey,

              sorry for the late update..At POE, they have issued me I94 till 2010 which is my petition expiry date..So it doesnt matter when your visa expires...
