  • Need Help - L1B Renewal and L2 - a slightly unique situation

    Hi everyone,

    I have followed this forum for quite a long time, and has

    My L1B Visa(also I797) expires at the end of Nov 2008. I was working in the US for 5 months from April to August 2006, after which I was sent back to India. Therefore, I have stayed outside the US for over an year. I have proper W2 and have filed my taxes appropriately though.

    Now, my company wants me to go back to our US office, in the beginning of June. My marriage is decided for the mid of Nov2008.

    My queries, thus, are:
    1). Does my staying out of US, for a prolonged time, have any effect on joining my US office again on June, especially @ the POE?

    2). By when would you suggest/think that my Company apply for L1B extension?

    3). Would it be appropriate to set-up my L1B renewal and my wife's L2 visa interviews, few weeks before the existing L1B visa expires, at the consulate in India, few days after the marriage?

    Your help is sincerely appreciated.

    1) Not a problem as long as your I-797 and visa are valid. A job offer letter/invitation letter is a good thing to have.

    2) 6 months in advance is recommended. That means as soon as you enter the U.S would work.

        Change of Situation

        Hi DMX/others,

        I might not be able to travel to the US till November and might overshoot my Visa Expiry Date(whilst still in India).

        1>. Is it possible or my US office to apply for the L1B extension while am still in India?
        2>. If so, would there be a problem of I94 (since i already returned it, prior to my flight back to India) ?

        3>. If Not what are my options?


        Please help me with these queries.

          1. Yes
          2. You need to enter with the renewed petition to get an I-94 at POE till the end of the petition. If not, another renewal might be needed. I-94 is of importance while you are in US and aplying for EOS (Extension of stay).
          3. Come now, apply for extension in the US or Apply for extension, come after getting the approval notice.
