  • bond breakage

    Hi,

I came here on L1 in jan'2008 from one of top indian companies in india.

Before coming here I signed few papers(bond) of 15000$ for 1 year to this company, if I cant not complete 1 year on the project.

Can the company sue me if I break this bond( I am unable to complete few assignmets on time, and I heard client is loosing interest on me).Can my indian company sue me if I return to india before completing the 1 year.

Is this bond valid in India/USA.
    Plz let me know.

That is not likely going to happen if you return to work for the same company. In most cases, it is to prevent attrition that these companies do that.

Bonded labor is not valid in USA. It might be a contract that you signed which you are calling a bond which is valid in USA.

My guess, You would be breaking a bond only if you are shifting company after coming to US (by applying H1 or so).

One of my friends had singed a bond for 4000USD before coming to US (i.e. if he leaves company before 6 months, then he has to pay this penalty) .

He shifted his company within 3 months but as per agreement he ended up paying penalty of 4000USD.

I do not see similar case of yours, this is something you need to ask to HR or your Indian company.
