I understand that in applying for an L1-Visa, one has to have worked for a subsidiary/brother/parent company in another country for 12 months before being able to apply for the visa. At the end of August 2008, I will have worked for an American company, based in the UK, for 12 months, and I plan to apply for an L1-Visa at the end of this 12 month period.
However, I am planning a short, two-week vacation in the USA to visit some friends in July. Will this two weeks, which I'm taking as my paid, annual, company leave, be counted as part of the 12 months consecutive employment (I will still be employed by the company), and therefore affect my application? What is the definition of 12 months... does it include the annual leave that employees are given by the company, or do you have to work a full 12 months with no annual leave and then apply?
I'd hate to jeopardize my application and so I'd appreciate your assistance in this matter.
