Hi Came to US on L2 and was working on L2 with EAD till Sep 07.from Oct 07 i started work on HiB. I just want to know If i cancel My h1b, Can i work on EAD on L-2 Status. My Ead is valid from 5th Feb 07 to 4th Feb 09.

You have to file for a COS to L2 from H1b. If H1b is cancelled, you don't fall back or return to your previously held status automatically. All status changes are handled and need to be approved by USCIS.

Continuing job on EAD after getting H1-B approved
Hi txh1b! thanks for all your valuable inputs..Can you please clarify below questions..Its little urgent.
Currently my Wife is working on L2 (EAD).This year(2008) both our H1 application(with COS from Oct 1st 2008) got selected in the lottery through a consulatanting company ABC.Will her L2 EAD becomes invalid after Oct1st 2008. Can she continue her current job on EAD. Her EAD is valid till Feb 2008.
We are looking for below three options: Please suggest us which one would be better option:
a) Can you tell me how my Wife can continue her L2 permanent job with the client using her new approved H1 after Oct 1st. Can she transfer her H1(if client Agrees) to the client from consulatanting company ABC who applied her H1.Do we need to notify this to the employer who applied her H1 or can this be done with out notifying him?
In this case Client may also be ready to Process her Green card using her H1.
b) Can she work with the client as contractor through the consulatanting company ABC which filed her H1? Can she switch back from Permanent position to Contracting position. In this case the consulatanting company is ready to process her Green card if she joins them.
c) If client doesn’t agree for H1 transfer and asks her to continue her permanent job on her L2 EAD.
What steps need to be taken to reinstate her L2 status. Her EAD is currently valid till Feb 2008.Last edited by byk; 05-29-2008, 12:12 PM.

Change of status from H1 to L2_Urgent please
Hi txh1b,
This is little urgent.Currently I am working client using my L2 EAD.
I have L2 visa is valid till 20th Dec, 2009 and my L2 I-94 is valid till 10th Jan,2010. EAD is valid till Feb,2009.
I have applied for her H1 in this year through another company and it got approved with effective H1 COS from Oct 1st,2008. Now the client is asking me to continue working on L2 EAD and threatening to terminate the employment is I fails to do so.
In the below post you mention we can file for a COS from H1B to L2
1)Who has to Apply for this? Can i apply on my own or my Company who is holding my H1 has to apply for this?
2)How long will it take for COS from H1B to L2.Her H1 Kicks in from Oct 1st.
3) Is there any other way to do this COS before Oct 1st.
Any quick response on this is appriciated?Thanks much for your help in advance.

1. You have to apply for L2 extension before you enter H1b status. COS may get complicated here. Best is leap frog if you want to maintain L2 and work on it.
2. 2- 6 months. Travel is the best option.
3. Travel
How can one threaten to work on a status. It is your choice and employer has no say in it.

Thanks for your answers.How can i apply for L2 extension? The client is asking for letter from an attorney explaining how i can ensure L2 status even after Oct 1st.The reason is I joined as an employee of company on L2 EAD and they want me to maintain the same status.
I know that i can do Leap frog and it will work fine.But is that Legal way to do and will any attoreny give a letter assuring the same. Any reference documents related to this will help me alot. I am trying to find an attorney.Can you tell exactly what should be there in that letter to convince the client..Please help me out here..its litttle urgent.
