  • L2->h1-> L2 Cos

    Hi all,

    Am on L2 from Dec 06,2006 to Sept 30,2007
    on H1 from Oct 01, 2007 till date(which is COS,not having stamp in my pp)

    if I want to COS to L2 again and fill in the form I-129(keeping in mind that my spouse's L1 is valid), have few qns:

    1)can i work on L2 EAD up on receiving the receipt num?
    2)is my earlier EAD still valid to work(if the earlier issued EAD is valid till feb 2009)
    3)i wish to be on L2 from Oct 01,2008 again..so approximately when can i apply for, i fall under California serv center.
    4)can i apply on my own(i.e independent) or my Spouse's company should apply for COS to L2?
    5)and if am on L2 for ex from Oct 2008 and i want to reenter on H1(with stamp) in Jul 2009, i wont be having paystubs from oct-jul 2009. will this be a problem for me during the stamping???

    Form is I539 not I129.

    1. No. You have to wait for the approval.
    2. Presumably valid but only after your status changes to L2.
    3. Check the processing tiome for I539 and plan accordingly.
    4. You can along with the spouse paperwork.
    5. Not a problem. You have a reason for the missing paychecks. Yopu need to have a job and a good employer for successful H1b stamping.

      ThanQ for the repsonses n correcting me thou one qn came up again:
      4. You can along with the spouse paperwork.--->my husband already in US on L1, so he dont have any paperwork to finish...in this case can we ask them to process or we can file for COS on our own and which is the best way?

        It is between his employer and what they handle. You have to check with them. They can file or you can file along with proof of husband's status on L1 etc.

        And lastly, don't use SMS type language on the forum. I am dyslexic to SMS language on the forum.

          Thank you....and i do really dont like the short forms/SMS language or highlighting etc...but i think i made short form(n,qn,PP,serv)
