  • Work Permit (EAD) for L2 Holders

    Hi,

I am an Oracle DBA working at a reputed company in Bangalore INDIA.
I am planning to come to USA in a month on L2 visa (Dependent of L1 holder). My husband holds L1 and works in USA.

My questions are as follows :

    1. Am I eligible to apply for EAD and there for work in USA ?
    2. If yes, Can I work in any company where I get job ?
    3. Can I get something (some reference or letter) related to my eligibility from USCIS or their website which is counted as authentic as of day?
    4. I may get a project in the same company(where I am now in India) office in USA if I get my EAD after coming USA. Is this possible or allowed with respect to USCIS laws?

Please reply as soon as possible. I need to provide information to my company to expedite the process.

    Regards,

    Sushma

    1. Yes
    2. Yes, only after you get the EAD approved.
    3. Eligibility under 8 CFR 274a.12 (a) (18). Look it up on USCIS.gov
    4. Yes

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

      1. Am I eligible to apply for EAD and there for work in USA ?

--Yes ofcourse, L2 is Dependant visa and doesn't care about what you do presently.

      2. If yes, Can I work in any company where I get job ?

-- Yes, in any company, provided company agrees that your status is depends upon L1. If L1 is leaving country then you have to leave too.

      3. Can I get something (some reference or letter) related to my eligibility from USCIS or their website which is counted as authentic as of day?

-- Not sure what is that. Upon your arrival in USA, you will have to apply for an EAD(takes 90 days), You can work only after approval of an EAD.

      4. I may get a project in the same company(where I am now in India) office in USA if I get my EAD after coming USA. Is this possible or allowed with respect to USCIS laws?

-- There is no problem working with any company and any kind of job.
I am not a lawyer and this is not a legal advice. Use it at your own risk. Consult professionals before getting into an action.
