    Since he already has a cap counted H1, the company rule mentioned to you is incorrect. The company can transfer his existing H1b to them and send him to US on a H1b.

    The way the questions were answered were not right resulting in a L1 rejection. Look at the L1 requirements and qualifications in detail. The VO may have also thought you were working in the company for 2 months.

        Read the H1b FAQs on the website. A visa cancellation does not restrict an individual from using the cap counted H1b petition with a different employer by means of a transfer. You just have to get a new I797 approved, go for another H1b stamping and come on h1b. It need not wait until next year and can be done now as soon as USCIS approved the transfer of H1 to your current company.

        Was the visa cancelled or the H1b petition itself revoked by the consulate? The former is good as per my explanation above and the latter is bad as a new cap number has to be obtained.

            No. It means what it says. The visa was cancelled for no fault on your side but for admin reasons.

                There is no faster easier approach. H1b visa can be transferred in 15 days using premium processing. Your company should know the pros of L1 blanket. Did you read about L1 visa on immihelp main page?

                Your choice at the end of the day. L1 blanket rejection and reapplying may not work from my guess as the VO has determined the blanket is not approvable.
