H1B stamping and entry with L1b

  • H1B stamping and entry with L1b

    Hello,

    I'm working for company A who hs sponsored by L1B and in the USA for last 1 year. I've got my H1B filed from company B this year and it's approced with COS from L1B to H1B. I've to join company B on Oct 01 2008.

    I'm planning to do leap frog and come back in November on L1B visa.

    Given the above condition my questions are:

    a) If I go back to my home country and get my H1B stamped on Oct 12, will my L1B stand invalid ?

    b) Can I come back on L1B in Nov eventhough my H1B is stamped ?

    c) In Jan 09, can I resign from the L1B company and join H1B company in Feb 09 with my H1B that was stamped in Oct 12 ?

    a) L1 May be cancelled after H1B stamping.
    b)If your L1B will be cancelled then you have to enter with H1B so you cant work ob L1B.
    c)No, if you want to continue with L1B then go out of USA and don't go for stamping(H1B) and enter after 1st Oct with L1B.In future When you want to start with H1B then you have to go out of USA and do the H1B stamping.

    Please check with attorney before taking any step.
