  • L1 Approved but dont have the new I-94 - Travelling to India

    Hi,

My L1 is expiring on Aug 5 2008. My company filed for an extension, and in the USCIS site, the status is approved. My company attorney is yet to receive the Approved Petition papers from USCIS. So, currently I dont have my new extended petition and the newly approved I-94.

I have booked my tickets to India (before getting approval) on august 6th 2008.

    1. Will I be out of status, if in case my flight get cancelled or delayed, Even though legally my status is approved, but I dont have the new documents (the new approved I-94) with me.

    2. Can I show them my L1 Extension Receipt for my legal stay?

    Please help !!

No one will ask for your legal status while departing US. But, you need to subit your I-94 which has expired along with the extension I-94 for it to be processed properly. However, you stay, if extended will be on the same I-94 # and hence will not be a big issue.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
