    Hi,
    I found this forum very helpful and i would like to request some feedback on which US Visa to transfer

    Scenario

    I am currently working with Company ABC , I don't have any US visa as of now as the company still cant decide which US visa to file.

    They are planning to send me to US for a year, The dilemna is that I also have an H1B with Company XYZ valid for 3 years ( Aug 2007 - Aug 2010 ), although I have never used my H1B for travel as I didnt hear from Company XYZ.

    Now, which visa should I ask them to file such that it wont jeopardize my future.

    For L1B - they are telling me not qualify as I graduated Industrial Engineering

    They suggested for L1A, according to them it is easier, however I dont have US resource to supervise but only local resources and filling up like managerial tasks.

    Now they are asking to utilize my H1B and have it

    "H-1B Approval Notice from a former employer may allow us to file a CAP-EXEMPT H-1B petition on my behalf.

    Given the facts of this case, filing a premium processing CAP-EXEMPT H-1B petition seems to be the best mechanism for securing prompt employment authorization on behalf of myself. However, please note, given that Company ABC did not file the original H-1B petition on behalf of myself and that it does not appear that I ever entered the US in H-1B status, it is uncertain whether or not the USCIS will approve the petition."

    What are the good options that I can worked on. I'm also looking that once I'm there for one year, I would like to offer my H1B status to company DEF to get a permanent job.

    Also my fiancee is currently a Permanent Resident, although we are thinking if we can get married soon or should we wait for my fiancee to get the citizenship before getting married as the V visa has long backlog.

    Search for remainder on the forum. The H1b can be transferred to your current employer. There was a recent success story as well.

      L1 or h1b (with remainder option) both will work for you. apply for any one..
