  • I-94 question

    I am on L2 Visa and I came back from vacation in sep2006. At POE the officer gave me I94 valid only upto my passport expiration date which is 08/31/08 and said when you get your pp renewed, you can apply for renewal of I94. So I applied for new pp and got it in Jan 08. After that my husband's employer applied for I539 in Mar 08 to extend my stay as the visa is good until Aug 2009 but I haven't received any updates on my application. My EAD has expired too because of the same reason. I lost my job and now I am thinking to visit India but the receipt notice says I cannot travel if the application is pending. So now my questions are:

    1. can I travel with 1539 pending?
    2. what happens when I come back at POE? any possible issues?
    3. what should I do with my new I 94 that I am hoping to get while I am in India?

    You are fine to travel to India and come back before expiration of your passport.

    If you travel to India before expiration and want to come back after it has expired, you need to get a new passport in India. Always carry the old passport with you as long as it has valid visas.

    Well you might face problem at PoE as visa should be valid for 6 months to travel I guess (??) Delaying international travel looks like the best option for now. You dont need to wait for your petition for extension of stay approval, but can travel as soon as you get new ppt.

      Thank you so much for quick reply. My passport is already renewed and the old one has visa until aug 2009. what should I do with the I94 which I will receive when i am gone as I am gonna get a new one on my return from Ind?

        Do nothing with that new I-94.

        Get your new approval shipped to you and carry that when you re-enter the US and produce at PoE.
