My status is as follows:
Currently on L1B Visa (Valid till Dec 2008)
H1B petition with COS approved (Valid from Oct 1st, 2008)
My question is as follows:
(1) I will not be able to join my H1B employer rightaway. I will be going back to India on September 2008 and will be returning back to US only on March2009. In this scenario, I would have to get my H1B visa stamped in India when I return. The COS (valid from Oct 1 2008) would become invalid then. Would the invalid COS affect my chances of getting my H1B visa stamped in India in any way? Would I have a problem returning to US on H1B?
Please advise!!!!!
