L1 expiring, no extension.

am on H1.My husbands L1 B is expiring Feb '09.His employer said 2 days back that as most L1 extension applications are getting RFE's, to avoid this they are not applying for any extensions from now on.(L1B to L1B, new petition L1B to L1A also)

thing is am expecting the baby mid Nov'08.its lil risk to take the baby on air travel for 1.5 days at a stretch at 3months age.
how to approach the visa cell of his company and request for extension of our stay for atleast 2 months so that we can leave to India in May/June '09.

is there any legal way other than he taking the visa status as H4.

H4 is your best bet and the safest. You can just come clean to the company with truth for applying for extension, dont see any other way.
