H1 approval and L1 status

    Hello,

    I'm in the US working for company A on L1B visa and I've applied for H1B this year with COS from L1B to H1B. The approval is still pending.
    I'm not sure when USCIS approve.

    My L1B is valid till July 09.

    The receipt number that the consultant has give me, still have the status pending. Not sure what's wrong.

    Anyways, I want to continue to work on L1B visa after Oct 01 2008.
    For the forum, I understood that I have to go out of the US Before Oct 01 and enter the US after Oct 01 and better to go out of Amercian continent.

    I've planned to go to my home country on Sept 10 and will be back to the US on Oct 12.

    My questions are:

    1) If my H1B does not get approved before Sept 10, how will that affect my H1B visa that is still pending with USCIS ?

    2) Can I enter US on Oct 12 with my L1B visa anc continue to work for company A ?

    3) Will my employer B who has filed for my H1, create any problems in future ?

    Please let me know. I'm really tensed now.

      1. No impact other than void of COS which is what you want anyway.

        After coming back to the US on L1B visa, I'm planning to take up H1 job in April 09. I'll be again going out in March. Get H1B visa stamped and come back to the US in April 09.

        Will USCIS question the employer that while you have been holding an H1 why is the person not working ? Will this impact me ?

          No such issues. An employer can choose to hold an inactive h1b.
