H1B to L1

Hi,

I am currently on L1 through company A (visa expired but petition still valid). Company B processed my H1 this year. However, I want to continue with company A. I was suggested by admins in this forum and elsewhere to go to leapfrog method to avoid my H1 to become applicable from 01Oct. This is what I am planning to do and need confirmation:

Leave US (with wife) on 28-Sep
Go to chennai on 06-Oct and get L1 and L2 visas stamped.
I Travel back to US (alone) on 18th October
Wife travels back to US (alone) in Jan

Any issues with this plan? Primarily, id it okay to go for L1 visa stamping after 01Oct or should I go for L1 stamping before 01Oct?

Also, are there any risks in this? What should I tell teh consulate officer as the reason for not moving to H1?

If you had no intention of working on H1B, why did you file and deprive someone else the visa?

That is not my intension. I will be taking up the job with H1B later. However, because of various reasons, I want to continue with my current employer for another 6 months before moving to a new job.

Can you please provide your suggestions?
