  • Very Urgent!!!-L1,L2 going for H1,H4 stamping in Mexico

    Hi Friends,

    I came to US in L1 and applied for a H1 in April 2007.It got approved with COS effective Oct 2007.

    I was not able to join H1 employer immediately.I went out of country for my marriage and entered with my wife in L1,L2 and continued working in L1 till now(Oct 2008).And now i am planning to join my H1 employer.So i am planning for a H1 stamping in mexico.

    I thought of just taking my wife with me for stamping.I just have my I797 petition , LCA and other documents sent by employer for me.

    Is there anything i need to carry additional for my wife for getting H4 .Ofcourse i have our marriage certificate and photo albums and her current L2 visa stamped in her passport.

    I have stamping next thursday.So please clarify as soon as possible.

      Just follow the documents list on immihelp. You will be fine.

        But my employer said i cannot take her to Mexico for H4 stamping .He said it needs additional processing.He said she can remain in L2 in US and later
        he would file for L2 - H4 COS.

        But i am afraid to leave her in US and go alone for stamping in Mexico.

        Please Note that we are L1,L2 to First time H1,H4 stamping case in Mexico.

        Your suggestion is invaluable to me.I have stamping on coming thursday.

          Time Running Out!!.Please somebody help

          I just have I797 which got approved before my marriage and have documents only for me,i797 ,LCA,i129 etc.Nothing specific for my wife other than
          our marriage certificate, photo album and her current L2.Can i take her
          for L1,L2 to H1,H4 stamping in mexico.I just have 3 more days please can
          somebody answer asap.

            Your employer is very wrong. Once you get your H1b stamp and enter on H1b, the L2, if she remains in the US becomes illegal and out of status until a COS is filed which could result in COS denial.

                    The Documents i have

                    My I797 which got approved before my marriage in April 2007.
                    My I129
                    My LCA
                    My W2 forms before my marriage(Recently i got married).
                    Offer letter.
                    Marriage certificate.
                    Marriage Photo Album.

                    No document specific to my wife.Since i recently got married.

                    Your Inputs are invaluable to me.

                      What about your current status proof like paystubs? You are being paranoid for no reason.

                        Thanks txh1b.I have all pay stubs till Oct , 2008.And even now i am working in L1.

                        I got all these doubts , just because my employer wanted me to go alone for stamping , leaving my wife in L2 in US.

                        Again Is the documents i said above is enough?.

                          I had posted the same in another forum.One of the member is saying that
                          my wife should have a H4 petition Is it true?.I dont have any other document other than our marriage certificate , Photo Albums and her Current L2 stamped in her passport.

                            That member probably does not know what you are talking about.

                            1. If your H1b was a COS, then your wife would need a H4 COS if she continued to stay in US.

                            2. You entered on L1/L2 and now you want to go for H1/H4 together. That is the way it works. Or apply for an amendment to change your status and your wife's status to H1/H4 at the same time.

                            If you fish for information in multiple places, you are bound to get confused. Talk to a lawyer as you are being too paranoid for no reason for a simple case.

                            Only problem I see with your case was you worked on L1 even after getting a H1b COS last year until you left and came back again on L1 which is illegal.
