  • Rights if you lose your job - L1 Visa

    Hi All,

What rights do I have if I lose my job whilst on an L1 (intra-company transfer) visa? Given the state of the economy, there it is a distinct possibility that people on visas may be made redundant.

1a). If I lose my job, I am assuming my L1 visa immediately becomes invalid. How long can I legally stay in the US? Is this dictated by the number by the expiry date of my I-94 or is there a pre-defined period of time?

1b) Can this be converted to a visitors visa?

    2. What rights do I have in terms of, severance pay and relocation costs should I be forced to move back to my home country immediately?

    Thanks in advance.

    Regards,
    Max

1a. Zero days. The last day of your job is the last day of your valid status as per the books.
1b. If one wants to remain for a few days after the termination to wind up things, it is suggested that they apply for a COS to B2, wind up ASAP and leave the country. This will help them avoid any out of status/illegal stay violations.

    2. Why severance pay? The company might have to relocate you overseas and pay you there for your job. Severance pay is never a right but companies give that to avoid wrongful termination lawsuits and to be on the good books of employees and the public.
