Applying for L2 after L1B refusal

Hi,

I really need a information/opinion.

I and my wife work in the same IT orgranization in India. Currently I'm in US on L1B Blanket.

My wife's L1B Blanket Visa got refused 45 days back at the consulte in india. She has been given a 221(g), but no additional docs were requested.

She is planning to resign from the organization and appear for the visa interview for L2 with the release letter (she will get that after her last working day) and other documents pertaining to my petition.

However, she was earlier in US from a different compny on L1B Blanket and she has her SSN.

Could any one please suggest whether she can be given L2 this time? We are concerned because her L1B got refused recently and she has work experience in US.

We will really appreciate an early response.

221g is not a denial; it is a request for more inofrmation. I suspect USCIS wants more project documents. If she waits for processing to complete and receives the visa, you then are doubly proteced in case one of your two projects is transfered. I suggest waiting for the decision.

thanks for your suggestion.. but her company is not willing to process her L-1 again... actually lot L-1 are getting refused now-a-days... so could you please suggest whether she can get the L-2? I mean what is the probability? our main concerns are 1) her L-1 got refused recently and 2) she has her SSN and she has worked in US earlier...
