  • L1 expired - waiting time to renew?

    I had a L1-B which expired in April 2008 under a blanket petition. The company applied for a H1-B which was denied under the quota allocation.

    According to the link on this site : https://www.immihelp.com/usa-visas/l1/

    I have to work abroad for 1 continuous year before eligibility (I assume I could re-apply for a L1 April 2009 as I have spent my time in the UK). I noticed under the title "Blanket L-1 Petition" it states - "Only if the employer has a blanket.......time of employment abroad is shortened from one year to six months."

    Am I correct in assuming that I can apply for a new L1 under my companies blanket approval in October 2008 or am I still required to wait one year.

    There is no wait period if you did not complete 5 years on L1. Your employer has to apply for the petition, not you. Doesn't your company have an immigration department?

      Sorry for not being clear - I did the full 5 years in the L1 and thats why they were trying for the H1. The company subcontracts the legal work so I am doing my own research for options.
