  • 1Yr continous work before next L1 apply ?

    Hi,

I was there in US last year on a business trip [no salary in $,only per diem]and returned back on 1st Jan'08. Now I got blanket L1B petition approved and going for interview at consulate within next few days[before 31 Dec]. I heard that there are some rules regarding 1year of continus work before applying for L1 visa. How valid is this in my case as I'm working for about 2 yrs in same company except 2.5 months business tour last year ?

Is this 1 year calculated as 365 days continous stay in India before next travel date to US or it's calculated from the date of entry in India to the date when one goes for visa stamping ?

Although if L1B visa is granted then my probable travel date will be not before than Feb'08 [after 1 yr since last visit, mentioned it in DS-156 too].

Please guide me on this. Whether this duration [going for interview after almost 350-355 days of stay in India] can create any issues in visa interview ? Should I delay my visa interview ? Looking for an urgent response as my visa interview is scheduled within next 7 days.

    Thanks

If your business travel was related to your work at that company, and you were still employed by the company all that time, you should be good.
This is my opinion and not legal advice.
