  • Can I leave US when L1A Visa has resumed?

Could I leave Us when L1 petition case has resumed? I'm still in US now.

if I went out,can I wait for the result from USCIS in my country?
ro I have to reapply in the future?

    What does "resumed" mean?

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

If your L1 I-94 has already expired and you leave, there is a likelihood of the EOS getting denied which would possibly be an issue for future entry. It is the same situation even if you stay in US and EOS gets denied.

          Thanks for you reply.

My I-94 has already expiried on Oct.30.
And I got the RFE on Oct.27.
USCIS updated the evidence receiving on Dec.7.

1,Do you mean I can leave US to wait for the petition result ,
or I still have to stay in US to get the result no matter it denied or approved?

2,The attorney told me I can't leave US when waiting for the result,is it right?

Because I want to go to my country now.

          Thanks

Follow what your attorney said. If you leave, like I said in my earlier post, you will have problems.

              Thanks txh1b
I am just tired of staying in US.
              Homesick is making my crazy.

It looks like waiting is the only way for me.
              Wish result come soon.

              Thanks for your answer.

                Look into premium processing.

My petition was submitted as premium application.
USCIS updated the evidence receiving and case processing has resumed on Dec.7
Usually it will take how many days to get a result?
                  Thanks.txh1b
