H1 Petition Validity Vs Fresh L2 Visa
My Fiance currently has a H1 petition valid for 3 years and is in the US . Visa is not yet stamped.
She was laid off from her company with 2 months severance pay.As per company officials the INS will be informed after 21 days
but the termination letter is of date ( 12th Dec) .
I am in the process of getting a fresh L1A blanket petition and Visa and currently on vacation in India
Can my fiance return to India , we get married and get a L2 Visa and travel on it without affecting the H1 petitions validity. Basically we want to safeguard the H1 Petition and use it later?
Can my Fiance work on the L2 Visa?
Does she have to travel to India before she begins work on H1 again ?
