  • L1B extension - Visa staming - please advise - Urgent

    Hi,MY L1B extension is approved here upto dec 2010.I am planning going to India for stamping.I have the following concerns please advise me.

    1) I belongs to x company and petitioner also the same company.I am working for Y company which has major stake in X and both the companies are affiliated.

    at my worksite i am monitored by Y manager.

    My question is shall i meet Visa consulate regulations for L1?.

    As per the new L1 visa regulations announced by the American Consulate General, Chennai on 26 Sep, 2005, Blanket L1 visas can be processed only if associates:

    · Have a Bachelors Degree in Computer Science (BE, Computer Science, Information Technology or BSC-Computer Science or BCA , MCA if you hold a Bachelor’s in Computer Science)

    · Are supervised by a Onsite Manager employed by the same petitioning company who is on an L1A or on Green Card (Supervisor should not be on a H1B or an L1B)

    · The supervisor should physically be present on the same premises of work as the applicant

    · Supervisor or Onsite Manager is defined as a person who has authority to evaluate the person reporting to him and decides on his appraisals.

    · Onsite Coordinators are NOT considered as Supervisors.

    · Should possess good communication skills

    2) MY L1B is individual .does L1B individual also requires the petitioner manager should exist at the work site?
    Can't my Y manager satisfy this requirement?

    Your company seems to be misusing L1bs from what I see. Unless the details of the stake etc are known, it seems fishy. Talk to your lawyer.

      Thanks txh1b for quick reply.stakes are known . Y holds 51% X and all manager control.

      My concern is about onsite manager requirement as per L1B visa regulations

        Why did Y not petition for L1 then? AGain talk to your lawyer. It may seem okay but the details have to be sorted out. Seems fishy to me with the arrangement going on.
