L1 visa till Oct 2009 but returned home. Can L2 be applied with the valid L1?

Hi, I have a valid L1 visa till Oct 2009, but I came back to home country as the project was closed. I have least chances of going back to US again within Oct 2009. I wish to ask if my wife can still apply for L2 now and travel to US? Please clarify.

L2 can enter and remain in US only when L1 is having a proper work assignment and getting paid. They just cannot enter and stay in US on L2 without the L1.

When your new assignment is decided, she can appear for the visa.
