L2 visa holders stay after L1 visa holder back

Hello Everyone,

I need a quick response for my question...Please help..

My L-1 visa expired in May 2006 and I applied for an extension . Now I have a valid I-94 until May 28th , 2008.

I am asked to return to India on Feb 10th, 2008.

Is my wife who is on L2 eligible to stay in the US until May 28th 2008 (i.e her I-94 and petition date ).

I am getting different responses and need to know the exact law and time frame she can stay back.

L2 is a beneficiary of L1. Which means L2 can stay in US only if/until L1 maintaining valid status. If your company asking you to go back then L2 has to go back too. L2's visa/I-94 expiry does not matter if L1 has to go back by employer's decision.
