    Hi,

    I came on L1B with company A from India. I left company A and joined Company B(who filled my H1) in Oct 2008. Now company A has send a letter to my home in India saying that I need to pay the bond amount which i signed in India. Is it legal in USA to pay for these kind of bond? what are the implications for me while i work here in USA? will i face a problem when I return to india? please let me know what are the options i have.

    Ha ha is all I have got to say. It is a civil issue in your country and other countries do not care as long as it is not criminal.

      BOND payment

      Dude,

      I have no idea how aggressive your previous employer is. If they after bond offender then you will have issue once you go back.
      If they go to court and declare you absconding then you will be taken into custody as soon as you land in your country.

          Hi
          I would say if u are thinkg of nt paying check with ur friends if they had done anything....Now the IT market is down so i dont think they will not leave because its the money they are assured of if u break the bond.....So think 2 before u decide..if u r abroad inJob u should not mind it..Else U R GIVING UR PARENTS UNNECESSARY TENSION....Think carefully and take a good decision..

            financial fraud

            Not honoring the contract which involves money can be pursued as financial fraud. Now, indian laws are getting tougher in this area as well. They have speedy trials and the verdict is dispense expeditiously.
            Given the wordings in the contract, it won't take much of an effort to the company to establish that OP has breached the contract and is not paying.

            Once the company police complaint after court verdict, OP will land up in immigration database for sure.

              Bonded labor has been abolished long time ago as far as I know. No one can force one to work for some company or firm. These SW companies that try to hold people captive and avoid giving experience letters, holding degree certificates or taking unnecessary action on individuals deserve to burn in hell.

                Bonded labor

                When the employer forcefully or by means of deception get an employee sign some legal documents then only it is an act of forced labor or fraud labor practice.

                When two grown up sign any legal document fully knowing the extent of damage it may coz in the event of default make them liable for their actions. The party at loss cannot start crying foul when asked to pay up based on the documents.

                Earlier small companies were overlooking the defaulters because they were too busy recruiting new victims. But now the economy is doing bad, available pool is getting smarter so few people to fool around with has made these shady companies go after their defaulters. It is a business cycle so you should not be SHOCKED or SURPRISED.

                The early our people understand the better for them.
