EAD question

Hi,

My wife is currently on L2 and has SSN . Our visa is expiring in Feb 09 . We have already file for extension and I have the receipt copy of the same .
My wife wants to apply for an EAD
My question is
1) Can she apply now when there is just a month left for expiration of Visa ?
If yes then what will be the most likely expiration date on the EAD ?
2) I think the best will be to wait for the petition and then apply for EAD based on new I94 .
