  • L2 Visa and frequent travel from Canada to US

    Hi,
I'm currently on a work permit in Canada (been here for nearly 2 years). I have a L1 visa valid until 2011. My wife has a L2 visa. She intends to go to Buffalo from Toronto to give her exams this week. She needs to go to buffalo once in 2 months for 4 exams altogether. Will there be a problem traveling between Canada and US frequently (mostly on a single day visit) on a L2 visa? Can she travel without me having to accompany her? Can she tell the border immigration officer that she wants to go to Buffalo to give her exams? Please advice

She has to apply for a visitor visa for that purpose.

One cannot use L2 visa to enter US if the L1 is not maintaining such a status in the US. As a matter of fact, it is considered fraud and could lead to serious trouble.

Thanks Txb. She also has a B1 (business) issued when she was last working with her employer. She quit the job 2 years back. Can she use this B1 with a letter from the exam agency instead of L2. Will B1 be acceptable when she is not going to buffalo on business.

B1/B2 can be used as long as the visa does not have an annotation "B1 in lieu of H1"
