  • L1B to L1A

    I am in US on L1B and will be completing 5 years in March.
    I want to apply for L1A and was planning to go to my home country to get fresh L1A petition and visa and return back in April.
    But recently I heard that I can convert from L1B to L1A only prior to completing 4 years and 6 months of continuous stay in US.
    Now as I am past 4 yeras 6 months and will be comleting 5 years in March I am not eligible for L1A and need to spend 1 year outide US to be eligible again.

    P.S. For me it is not a conversion but a fresh petition as I will be going to India and apply for a new L1A petition.

    Experts please shed some liht if I am eligible for L1A.

    You seem to be eligible for 2 additional years of L1A from the way I look at it. Talk to your HR. The L1A regulations are pretty strict, at least now.

      Have you got any idea whether I can convert from L1B to L1A now as I will be completing continuous 5 year stay next month.
      Or Visa can only be converted 6 months prior to completing 5 year term.

        L1B to L1A - Same issue

        Did you able to get the L1A petetion? I have same issue.. I stayed in USA for more than 4 years 6mnths on L1B and now I want to apply for fresh L1A.. please advise..Thanks!

          L1B to L1A - urgent

          Dear Experts!!
          I am currently on L1B visa and my L1B visa is set to expire in Aug 2010. I will be also completing 5 years in L1B visa then.
          I am plannning to get a new L1A visa stamped. Is it possible now? Do we need to start the L1A visa processing 6 months before or can it be started now?

              I am working as Vice President of Sales for California Software (CSWL) Labs and have completed 2 year & 9 months of service in a subsidiary company of CSWL. I am working out of India. I want to know if I am eligible to move to US on L1A visa. If yes, what are the next steps that I need to take. How long it takes to get the L1A visa?

                >>> The employer will need to apply the L1A petition for you. When it gets approved by USCIS, you have to book a visa interview at the U.S consulate and prepare the documents listed in the below link. If the visa is approved, you can travel to U.S to work in L1A visa.

                How long it takes to get the L1A visa?
                >>> It depends. You need to find a visa interview slot and book the appointment (After the petition gets approved. Petition takes 2-3 months by normal process and 15 days by premium). Once the visa is approved, you will get the passport stamped and returned back to you within a week to 10 days.
