  • Unique L1 situtation

    I was laid off by my L1 Employer (lets say ABC Inc) this Feb 09. I joined this company in Jan 07 so a total employment period of 2 years and 1 month.

    My employer BEFORE ABC Inc (lets call it XYZ Inc) where I worked for 3 years (2003 to 2006) is ready to hire me back in the US. Can XYZ Inc file a L1 for me? Both ABC and XYZ are US based companies having offices in India.

    I read that if you you have worked for one year for an employer in the last 3 years, you are eligiable for L1. Since I am One month short of 1 year, can I apply for L1?

    Appreciate your help guys!!!

    It may not work for you as USCIS is already very strict on L1s and this 1 month may not help you get a L1.

    Talk to an attorney and see if it is possible. I would doubt it.

      What if I go to my home country and apply fo ra new L1 thru XYZ inc? Is that possible?
