Divorce - Urgent

Hello,

I've a friend whose husband is on H1 and she is on L1. They do not have any offspring.

My friend's husband has an extra marital affair with some other woman. He spends nights and days with the other woman and does not come home for around a week or so.
My friend thinks that he is going to elope with the other woman leaving her alone.

She wants a divorce case to be filed very soon in the US so that she can live peacefully.
They fight everyday even to the extent of inflicting physical abuse. She wants to end the relationship but her husband does not want to end.

What is the best option ? She is in the US and working for a reputed organization on L1. She'll be here till June 2011.

She can file for a divorce if they have lived in the state for atleast X number of days where X depends on the state law.

If it is mutual, it will be quick. If not, it will take couple of months as no children are involved.

It is not mutual my friend wants but her husband does not want the divorce.

Also, will divorce create any problems in her visa ?

Can she remarry after her divorce in the US?

No issues for the visa as she is on her own status. Of course she can remarry after the divorce.

Do we need to consult a family attorney for the divorce ?
She wants a very quick divorce. She has already moved out of their house and now residing alone in an apartment.

Yes. Some states require them to be separated for 6 months prior to divorce filings. An attorney can provide the best direction.

You are not clear with your own question or concern on one side you are saying that husband stays away from home for days together and on other had you also say that they fight every day ...? quite confusing now if you are attracted to another person while in relationship its always good to talk to your husband and tell me upfront that you are no long intrested in him and its good for both of you to move on with your lives and with mutual respect separate your ways this way you both will be happy and will have respect for each other even after the relation is dead...this is just my opinion ...

Read the message completely and try to understand the meaning in a positive attitude it jus shows the way that you are reacting is that you are not in the right frame of mind when you are going through this first advice is take a deep breath and what ever has happened and is happening without ones control is a reality and we cannot control it ( if we would or could then this wouldn't have happened ) so think about what is the best that you can do in full faith ....and once again if you read my message earlier i did say that its just my opinion not something that you got to do ....so calm down and try thinking about what i mentioned and trust me it will definately be good for you hopefully you do believe in theory of Karma ...! remeber that ..
