  • H1 to L1A COS after 6 years

    Hi,

    I came to US in April 2003 on L1b and subsequently my company applied for H1b in 2004 and renewed the same in 2006,so now i am completing 6 years in few more weeks.
    Total of 1 year on L1b & 5 years on H1b.
    My company applied for L1A Change of Status in December 2008 and my app status shows as RFE(Request For Evidence) and are expecting a mail with details in next 1-2 weeks.

    I have the following questions

    1. As i am completing 6 years in few more weeks and my L1A isd in process,how long can i stay legally in USA

    2. If my L1A is denied beyond 6 years time frame,will i get an opportunity to apply H1 extension for Out of Country time ?

    3. How much time would i get to leave USA if any issue occurs wiht my visa

    4. My Driving license is issued until valid date of my visa,with now that expriring and my L1A in process,how can i get it renewed.

    1. Until the application decision is made. You cannot work past the date of I797 of the current H1b unless the COS is approved.
    2. Not if the H1b I-94 already expired. H1b recapture has to be filed before the I-94 expires.
    3. Immediately after I-94 expires.
    4. Depends on your state law.

    The chances of your L1A conversion being rejected is high.
