  • L1B Extension and RFE

    L1B Extn applied in Dec 2008. I 94 expired in Jan 2009. Just came to know that I have received RFE.

    Please help me with the following questions as my HR may not answer everything or may delay in their response. This will also help me to ask more questions to my HR.

    1. Is it not the L1 companies responsibility to send the RFE copy to the employee for his future refernce.

    2. Eager to know on what could be the RFE all about.

    3. How much time do they give us to pack up and go back to india or to respond to RFE

    4. Can I go back and come on new L1B or L1A immediately. How long does it take and what are the chances of approvals.

    5. Due to health reasons of my wife I would like to continue for few more months in US. Can I apply for B2.

    6. What is my status now and what should I do to apply for B2. Is it a change of status to B2. Do i need to get letter from the doctors to apply for B2.

    7. Can I apply for B2 myself or should my company apply for B2. Do i need to go to attorney to apply for B2

    2. No one can tell. Most common is proof that what you do is a specialized knowledge.
    3. Depends on your I-94 date.
    4. Depends. Possible in general if you have not used up all 5 years.
    5. You can if your I-94 is still valid and you are in status.
    6. You should know if your I-94 expired, you are authorized to stay on a pending application. However, no other status changes are possible if it gets denied.
    7. Your choice. COmpany need not.

        The RFE talks about several things like contractual agreements with client, explain in detail about specilaized skills and also why not some other person from the L1 company who already have these skills.

        1. My I 94 already expired and has a pending RFE to repond by April 25. Can I assume that I am still in L1 Status and if required apply for change of status to B2

        2. I have been asked to go back to india and come on new L1 petition as soon as possible. Does this work? Does the Us consulate question me about the RFE whenI go for fresh Visa stamping

        3. What does those yellow/red card mean that some of the posts in this forum talk about when someone goes for a Visa stamping.

          1. No, you are NOT in status. You are in a psuedo status type thing called "period of authorized stay".
          2. Ask your HR. Your RFE will likely result in a rejection and hence the approach by the company.
          3. Read about it. Admin processing.
