L1 extension issues

Hello,

I'm in the US working on L1B visa.
My I94 is valid till Sept 2009. I've not filed for an extension yet.
The company has asked me to leave the US by Aug as they have received many L1B extn denials.

They told me to go back to India, they will file a new L1B petiton there and get consular processing done.

My questions are:

1) Will they file for extension of L1B ? or will they file a totally new petition for me ?

2) I know extn can happen only when a person is in the US. If this is the case, will the extn happen when I go back to India ?

3) What are the chances of my petition getting approved ?

Most likely a new petition. Ask your HR. They should answer these as they know what their plan of action is than the forum members.

So, is consular processing better than filing for an extension from the US ?
