  • L1B - I-140 approved, laid-off

    I am on L1B visa. My I-140 is approved more than 365 days back. I-485 is not filed so far as the priority date has not come yet. Meanwhile, if my company lays me off, I can not find another employer because of my visa status being L1B which is tied to the current employer. So, when my company lays me off, I have to go out of the country. In this case, is it possible to continue the I-485 processing?

    What are my options for continuing the GC/I-485 processing? Or are there any other options to get to the GC processing other than I-485 when I will be out of the country?

    Any information on this will be greatly appriciated.

    You are pretty much screwed with respect to GC unless you have another employer file for your labor and capture the PD. GC can be sponsored by any employer without you even being in the US.

        If they are laying you off, what makes USCIS believe they will hold a permanent job for you?
