Hi,
I am working for company A in US on L1B. My company applied for my L1 extension ( L1A conversion from L1B) in October 08 and there was RFE in Dec 2008, i am yet to receive the status from USCIS on extension.My visa and I-94 expired on Dec 8th 08.
I have valid approved H1(consular processing, not COS) in 2007 october through a consultant based in US. I have not worked on this H1 which is valid for 3 yrs. My H1 has no I-94 attached.
1.In case my L1 extension is denied, can i apply immediately for COS from L1 to H1 through company A while in US after denial? Does this required stamping?
2.In case i go back to India, can company A transfer my H1 in India and then i go for stamping in India. Is this possbile?
3.My husband is working on H1. In case of denial can i immediately apply for H4? Or should i apply for H4 even before denial? In that case will it effect my L1 extension process?
4.Is it true that if we dont hear anything about the case approval, a person needs to leave US 180 days after his 1-94 expiry?
Has anyone had similar situation? You response and help would be highly appreciated and help me in planning my actions in case my extension does not get through.
