    Sorry to bother you, i have read forums posts.

    due to my lack of knowledge i have over stayed on L1, even i got H1 approval ( 2008 )due to recession.

    looks my case is different from others, i understand if do leapfrog ( sorry to refer, i know you dont like this phrase ) before oct is ok, but i am doing very late.want to know if i do last action rule now, am in to trouble while POE at US.

    1.)could you tell me if i go to canada by air, any one collect my 1-94?
    2.) while enter in to US, shall i get new I-94 with out any Questions at POE becos my status is in H1 now technically, this is the reason i refered this as grace period in earlier thread.
    3.)i would like to know immigration procedures ( collecting, re-issue ) I-94?
    4.) if my H1 employer revokes my H1 ( not sure abt this ), is good idea to do last action rule, i may be in to bigger trouble at POE to US?

    by reading forums, worrying i am in big trouble, please help me out any suggestions to come out from this problems, am i need attorney ?

    i need to process canada visa ASAP, get it done and should be free from Issues.

    please, any directions will be appreciated

      180 days overstay and less than 365 will trigger a 3 year ban. More than that will trigger a 10 year ban. Act fast. Ignorance of the law isn't an excuse.

      Airlines will not collect I-94 for trips less than 30 days to Canada. You have to take a chance, travel to your home country after you talk to an attorney.

          I have one question.

          How different is doing last action rule before & after Octber?, becos read most of the people saying travel to canada retained their L1 staus by voiding H1, this doesn't mean they got new I-94 form ( CBP ), this what happens when we travel to parent country.they take I-94, and while return back to US issue new CBP form.
          This wont happen while travel to canada?.

          Dont misunderstand i am not trying to teach you.

            Only difference being your over stay keeps getting extended without a new I-94. For last action to truly work without any issues, a new I-94 is necessary. One that went and came back on the same I-94 essentially hasn't changed much though an entry stamp to Canada could arguably prove something which is beyond my level of interpretation.

            Talk to an attorney and get things cleaned up early in the immigration process if you can than wait for things to blow up later on.
