  • L1 to EAD pls help

    All gurus

    Currently my wife is on L1 and we got EAD 6 months back. I am still working on H1. My question is can my wife start a job on EAD right away that will terminate her L1 and move her to EAD. Do i need to apply for H4 for her. In essence can she work right away without applying for H4 and later i can do that.

    If she has an EAD and she uses it, she becomes a parolee. I am not sure I understand the last part of your question of changing over to H4.

      Currently she is on L1 but if she gets a job can she use EAD and join any company right away?
      I saw some where that EAD is not a real status, so do I need to apply H4 for her, or just activating EAD will be good enough for her to stay in the country as she needs to resign her current job on L1?

        No special "activation" needed for EAD. If she falls out of the non-immigrant status with a pending 485, she is automatically a parolee.

          I really appreciate your prompt reply, one thing I dint understand is how INS will know her status change from L1 to Pending 485, do I need to submit any form to INS? assuming that her L1 is terminated and she dint get any job on EAD

            Working as a parolee is optional for the derivative applicant on a 485. No special notification needed.
