Hello All Seniors,
Specially thx1b and others... This is my scenario..
I came to US Aug 08 on L1A for opening a new office in US of our company in India (software company) We had 1-2 contracts but they did not go through completely because of the economy and budget constraints and i was not paid my salary till today...
The company paid for my living (house, phone food) etc since i part own the company i let it go in hopes that we would start making $$ soon. As i understand i was out of status way long time back and my visa is up for renewal forget about renewal right now i am illegal i guess, i am still employed just not getting paid because we are still struggling.
Question is:
1. What should i do now since being out of status for such a long time.
2. If we manage to get our contracts again and if i am paid for the complete years salary after 1-2 months will my Out of Status be removed?
3. Now after some research i understand i was supposed to leave the country after 180 days which i did not but i did not know about it nor did USCIS inform me to do so...
4. From a legal stand point what do you recommend ? I do not want be barred permanently our products are good its just the economic situation which is bad right now..
Any help will be much appreciated this is bad i see a lot of H1b guys also getting affected because of being out of status..
