    Hi All,

    I arrived in the US in 2006 on an L1 visa. Last year while I stayed in US my Status changed from L1 to H1.

    I am planning to travel to India now and I need to get the H1 visa stamped on my passport.

    While I am trying to setup the consulate appointment, one of the questions is "Are you applying for the same class of visa which is currently valid or has expired within the past 12 months?". My current status is H1 though I entered US on L1. What is the right answer to this question?

    Yes or No?

    --- I had a similar situation when my wife went from H4 (stamped in Passport) to H1B and we went for her stamping. I had initially answered YES to that question thinking it is the VISA STATUS that the VFS is asking. I was told the stamp on the passport was H4 and since she was coming for H1B stamping, the answer should NO.

    I re-did the appointment with the answer as NO.

    So, just to clarify, the question that you have asked (or rather the VFS asks) is regarding the VISA STAMP and in your case it has to be NO, since you are going from L1 to H1B.

        visa and status are different things. VFS is only asking about visa in this case.
